The SCOTUS (Supreme Court of the U.S.) and WOTUS (Waters of the U.S.): Implications of the recent Sackett decision on the extent of wetlands in North Carolina

This presentation will summarize the recent US Supreme Court’s Sackett decision which narrowed the extent of the Clean Water Act, notably for the Section 404 Permitting portion of the Act implemented primarily by the US Army Corps of Engineers. Local examples of the impact of the decision will be discussed to illustrate the effect of the decision. Three basic summaries of the implications of the decision in N.C. will be addressed in the context of the regulatory extent of wetlands from least to moderate to the largest potential impact on the extent of wetlands regulated across the state. Finally, the overall environmental implications of the Sackett decision as well as the parallel decision by the NC Legislature will be addressed.
Continuing Education Credits: This forum will provide 1 PDH (professional development hour) credit upon completion of registration and evaluations that will be sent with the final event information. Each professional must determine if the content is relevant to his/her individual practice and suitable for his/her continuing education.

Guest Speaker: John R. Dorney, Senior Environmental Scientist, Axiom Environmental

Senior Environmental Scientist, Axiom Environmental and retired from NC Division of Water Quality, Wetlands and Stormwater Branch in 2011. Mr. Dorney worked with the Division of Water Quality for over 29 years, was actively involved in the development of the 401 Water Quality Certification Rules, the Isolated Wetland Rules, the Riparian Buffer Protection Rules, and the NC Stream Identification Method and has taught courses in the stream identification method as well as stream and wetland functional assessments for more than 15 years. He is an expert in wetland and stream functional assessment, isolated wetlands as well as wetland and stream permitting. Prior to working with Axiom Environmental, Mr. Dorney worked (mostly part-time) for two other private engineering firms for a total of about 11 additional years.
